Platform and ASP Terms (ECQ NEXT software)
Version: 2026-10-11
These terms govern the use of the ECQ NEXT software. The software is owned, developed and operated by TradingHive Technologies Ltd; the subscription is sold by EUROPEAN CENTRE QUALITY TAX CONSULTANCY L.L.C under its Terms of Sale.
1. Provider
TradingHive Technologies Ltd (DIFC licence CL9878, IH-00-01-01-OF-01, Level 1, Innovation One, Dubai International Financial Centre, Dubai, UAE) (TradingHive). TradingHive owns and develops the software and acts as the e-invoicing service provider (ASP).
2. Licence
For the term of the subscription the customer receives a non-exclusive, non-transferable right to use the ECQ NEXT software for its own business within the limits of the chosen plan. The software may not be copied, modified or reverse engineered.
3. Acceptable use
The platform may not be used for unlawful purposes, content that infringes the rights of others, circumventing security or overloading the service. Users keep their sign-in details secret and set up two-factor authentication when asked; the inviting customer is responsible for invited users.
4. Customer data
Customer data remains the customer's. TradingHive processes it as a processor, on the instructions of the customer and ECQ, to provide the service, using encrypted connections, role-based access, logging and regular backups. After termination it keeps the data until the end of the legal retention period and then deletes it.
5. E-invoicing and ASP service
Transmission of e-invoices over the Peppol network and reporting to the FTA are performed by TradingHive as accredited service provider (ASP) once accredited by the Ministry of Finance. Until then the platform does not transmit e-invoices. The customer is responsible for the content of its invoices.
6. Availability
TradingHive aims for continuous operation and announces planned maintenance in advance. Guaranteed availability (SLA) is offered only in an individual Enterprise agreement.
7. Intellectual property
The software and all its components belong to TradingHive. The ECQ NEXT and ECQ Dubai names and logos belong to ECQ. TradingHive may use customer feedback free of charge to develop the software.
8. Liability
The software is provided in its current state of development. TradingHive's liability is limited to the subscription fees paid by the customer in the previous 12 months; it is not liable for lost profit or indirect damage, except where the law does not allow such limitation.
9. Suspension and termination
The licence ends with the subscription. TradingHive may suspend access for a serious breach of these terms, a security risk or unlawful use.
10. Changes
We give at least 30 days' notice of changes to these terms by email and in the portal.
11. Governing law
These terms are governed by the laws of the Dubai International Financial Centre (DIFC); the DIFC Courts have jurisdiction.
